LEEANN FARRIS PHOTOGRAPHY — TERMS & CONDITIONS
This Agreement (“the Agreement”) is made between:
Leeanne Farris Photography (“the Photographer”)
and
the Client (“the Client”).
By submitting a booking form, paying a Booking Fee, purchasing a voucher or confirming a session date, the Client acknowledges that they have read, understood and agreed to be bound by the following Terms & Conditions.
This Agreement is governed exclusively by the laws of England and Wales.
1. Definitions
1.1 “Photographer” refers to Leeanne Farris Photography, including any authorised assistant or subcontractor.
1.2 “Client” refers to the person(s) booking the services.
1.3 “Event” refers to any wedding, family session, portrait session or photographic service.
1.4 “Gallery” refers to the final collection of edited digital images delivered online.
1.5 “Booking Fee” refers to the non-refundable amount required to secure the date.
2. Booking, Fees & Payment
2.1 A non-refundable Booking Fee is required to secure all bookings. No date is confirmed until this fee is paid.
2.2 Weddings: The remaining balance is due no later than 60 days before the Event.
2.3 Family/Portrait Sessions: The balance is due on or before the date of the session.
2.4 Wedding booking forms must be completed within 72 hours of issue or the date may be released.
2.5 Digital galleries are classified as non-refundable digital goods under the Consumer Contracts Regulations 2013.
2.6 Unauthorised chargebacks shall be pursued for the full balance and reasonable recovery costs.
3. Consumer Rights
3.1 Photography is a bespoke service. Once the Booking Fee is paid or work has commenced, the statutory cooling-off period no longer applies.
4. Copyright, Intellectual Property, Image Protection & Legal Enforcement (UK Law)
4.1 Ownership
All images (RAW, edited or unedited) remain the sole and exclusive copyright and intellectual property of the Photographer under the Copyright, Designs and Patents Act 1988. No copyright, ownership, intellectual property rights or moral rights are transferred to the Client at any point.
4.2 Licence to Client
The Client receives a non-exclusive personal-use licence only, permitting personal downloading, printing and sharing. This licence does not permit editing, resale, commercial use, third-party editing or unauthorised distribution.
4.3 Prohibited Uses
The Client and any third party may not:
• add filters, overlays, presets or colour alterations
• retouch, edit or manipulate images
• crop beyond basic social-media crops
• use any AI editing, regeneration or enhancement tools
• submit images to competitions, publications or awards
• use images for business, branding, marketing or influencer purposes
• provide images to other photographers, editors or designers
4.4 Third-Party Editing Strictly Forbidden (Including Family/Friends)
No third party — including but not limited to family members, friends, partners, acquaintances, hobbyists, amateur photographers, amateur editors, digital artists, influencers, siblings, or any individual offering to “help edit” — may alter, adjust or manipulate the images.
This prohibition also applies to:
• professional or amateur photographers
• freelance editors
• graphic designers
• print laboratories
• AI or machine-learning platforms
• “my brother edits photos” or “my friend knows Photoshop”
• any individual regardless of their intention or skill
Any third-party involvement constitutes copyright infringement.
4.5 Copyright Infringement & Legal Consequences
Any unauthorised editing or misuse constitutes copyright infringement. The Photographer may:
• terminate the Agreement
• retain all sums paid
• refuse to deliver remaining images
• issue takedown notices and removal requests
• pursue damages, legal fees and enforcement
• pursue statutory damages under UK copyright law
4.6 Admissions of Editing
Any admission — written, verbal, online, emailed, posted or messaged — that any person has edited or altered the images shall be treated as conclusive evidence of infringement.
4.7 Social Media Filters
Filters, presets or automatic adjustments made through Instagram, Facebook, TikTok, Snapchat or any platform constitute editing and are strictly prohibited.
4.8 Moral Rights
The Photographer asserts the moral right to be identified as the author. Clients must not imply another photographer created the images, remove watermarks (if applied), or misrepresent authorship.
4.9 RAW Files & Unedited Images (Strict No-Release Policy)
4.9.1 RAW files, unedited images, straight-out-of-camera images, proof images, and any unprocessed or partially edited files will never be delivered under any circumstances.
4.9.2 This policy is permanent, non-negotiable and forms part of the Photographer’s intellectual property rights.
4.9.3 RAW and unedited files are not part of the deliverable product.
4.9.4 Requests for RAW or unedited images will be automatically refused.
4.9.5 Attempting to obtain or demand RAW or unedited images constitutes a breach of contract.
4.10 Commercial Use
Images may not be used for commercial, business or influencer purposes without a separate commercial licence.
4.11 Portfolio Rights
Unless opted out in writing before the Event, the Photographer may use selected images for portfolio, marketing, website, social media and publication.
4.12 Indemnity
The Client indemnifies the Photographer for any losses, legal fees, damages or reputational harm arising from copyright infringement or misuse.
5. Wedding Image Quantities
Approximate minimum image numbers:
5.1 Bespoke Wedding Coverage: 250+ images
5.2 Half Day Coverage: 250+ images
5.3 Full Day Coverage: 500+ images
5.4 Deluxe Coverage: 750+ images
5.5 Exact numbers vary depending on circumstances. No specific image is guaranteed.
6. Family & Portrait Session Terms
6.1 Outdoor sessions may be rescheduled if weather is unsafe or unsuitable.
6.2 The Client may reschedule up to 48 hours in advance; cancellations within this period may result in loss of the Booking Fee.
6.3 The Photographer is not responsible for uncooperative behaviour from children or adults. No refunds or reshoots will be provided.
6.4 Bespoke family or portrait sessions include an approximate minimum of 20 edited images.
7. Complimentary Pre-Wedding Session
7.1 The session is a complimentary goodwill service, not a paid product.
7.2 It holds no cash value and cannot be moved after the wedding date.
7.3 Limited to the couple and dependent children.
7.4 The Photographer will deliver 20 fully edited images, chosen solely by the Photographer.
7.5 No guaranteed turnaround time.
7.6 Failure to attend results in forfeiture.
7.7 The Photographer may withdraw or modify the session without affecting the main wedding contract.
8. Editing, Delivery & Turnaround
8.1 All editing is completed in the Photographer’s established style.
8.2 Extensive retouching may incur additional fees.
8.3 Turnaround for galleries is estimated at 4–10 weeks.
8.4 Turnaround times are estimates, not guarantees. Delays do not constitute breach of contract.
8.5 Galleries are delivered via an online platform.
9. Behaviour, Conduct & Communication
9.1 The following constitutes a breach of contract:
• abrasive, aggressive or confrontational behaviour
• harassment, intimidation or threats
• unreasonable demands or pressure
• slanderous or defamatory communication
• attempts to micromanage or override professional judgment
• withholding required information
• disrespect toward the Photographer or assistants
9.2 The Photographer may withdraw services if the environment becomes hostile or unsafe.
9A. Defamation, Malicious Communication & Reputational Harm
9A.1 The Client must not engage in behaviour intended to damage or coerce the Photographer.
9A.2 Breach includes:
• threats of negative reviews
• reputational blackmail
• false or malicious allegations
• encouraging others to post defamatory content
• statements harming the Photographer’s reputation
9A.3 Threatening defamation is treated as equivalent to publishing it.
9A.4 The Photographer may take legal action under the Defamation Act 2013.
9A.5 The Photographer may terminate the Agreement, retain all sums paid, refuse delivery, and pursue damages.
9B. Communication, Working Hours & Boundaries
9B.1 Working hours may vary and are publicly listed.
9B.2 No obligation to respond outside working hours.
9B.3 Repeated out-of-hours contact or attempts to force a response constitute harassment.
9B.4 Response times vary during peak periods.
10. Liability & Insurance
10.1 Liability is limited to the total amount paid.
10.2 The Photographer holds Public Liability and Professional Indemnity Insurance.
10.3 The Photographer is not responsible for injuries, missed images or issues caused by venue restrictions, late guests or environmental limitations.
11. Force Majeure & Technical Failure
11.1 If images cannot be delivered due to illness, emergency or technical failure, the Client will receive a full refund or rescheduled session.
11.2 This is the Client’s sole remedy.
12. Substitute Photographer (Weddings)
12.1 A qualified substitute may be appointed if necessary.
12.2 If none is available, the Client receives a full refund including the Booking Fee.
13. Wedding Refund Policy
13.1 Client Cancellations:
• Booking Fee is non-refundable.
• If cancelling before 8 weeks and the balance has been paid, the Client will receive the balance minus the Booking Fee.
• Cancellations within 8 weeks receive no refund.
13.2 Photographer Cancellation:
A full refund is given if no substitute is available.
13.3 Refunds processed within 14 business days.
14. Archiving & Storage (Updated)
14.1 Once the Gallery is delivered, the Photographer does not guarantee retention of any files.
14.2 The Client is solely responsible for backing up their images immediately.
14.3 The Photographer accepts no liability for loss of images after delivery.
15. Venue Access & Restrictions
The Client must secure permissions for photography. The Photographer is not liable for restrictions or poor lighting imposed by venues or officiants.
16. Social Media & Sharing
Images may be shared online for personal use only.
No filters, edits or AI manipulation may be applied.
Altered images may be requested for removal.
17. Complaints
Complaints must be made in writing within 7 days of gallery delivery. The Photographer will respond professionally.
18. Meals & Breaks (Weddings)
A hot meal and reasonable breaks must be provided for coverage exceeding six hours.
19. Creative Control
The Client acknowledges satisfaction with the Photographer’s style.
All creative decisions are final.
20. Subcontracting
Subcontractors or editors may be used, but creative oversight remains with the Photographer.
21. Discretionary Post-Event Refund & Termination
21.1 The Photographer may issue a full refund if:
• the Client behaves abusively
• communication becomes unmanageable
• demands become hostile
• the relationship breaks down
21.2 If such a refund is issued:
• it is final
• all images (RAW and edited) are permanently deleted
• no gallery will be delivered
• all obligations cease immediately
22. Schedule Delays
Sessions run within booked time. Late arrival reduces shooting time.
23. Family Session Result Expectations
No guarantee of specific expressions, poses or behaviour-dependent outcomes.
24. No Guarantee of Favourable Appearance
The Photographer is not responsible for appearance, clothing, expressions or insecurities.
25. Hostile Environment / Shoot Suspension
Sessions may be suspended or terminated if the environment becomes unsafe or abusive. No refund will be provided.
26. No Refund for Client-Caused Issues
No refunds for lateness, intoxication, refusal to cooperate, ignoring guidance or poor clothing choices.
27. Punctuality
Sessions start and end at the scheduled time. Late arrival reduces coverage.
28. Client Interference
The Photographer maintains full creative control. Interference may result in session termination with no refund.
29. Weather, Location & Environmental Limitations
The Photographer is not liable for natural lighting conditions, crowds, distractions or limitations of the chosen location.
30. Unpaid Galleries & Abandoned Communication
Galleries will not be edited or released until full payment is received.
Abandoned communication does not entitle the Client to a refund.
31. Acceptance of Terms & Formation of Contract
31.1 By submitting a booking form, paying a Booking Fee, purchasing a voucher or scheduling a session, the Client accepts all Terms & Conditions.
31.2 Booking and/or payment forms a legally binding contract.
32. Gift Vouchers
32.1 Purchasing a voucher binds the purchaser and the Voucher Holder to these Terms & Conditions.
32.2 The Voucher Holder accepts these Terms upon redemption.
32.3 Vouchers have no cash value and must be redeemed within their stated validity.
